TECHNICAL RESCUE SERVICES ORDINANCE FOR THE CHATHAM COUMMUNTITY FIRE PROTECTION DISTRICTCHATHAM, ILLINOIS
WHEREAS, the Chatham Community Fire Protection District finds it in the best interest of the Chatham Community Fire Protection District to regulate, control, fix, charge, and collect reasonable fees for fire or other technical rescue services provided by the Chatham Community Fire Protection District; and WHEREAS, the Chatham Community Fire Protection District has determined that reimbursement for providing technical rescue services promotes the health, safety, and welfare of its residents, business owners, and those receiving any such technical rescue services; and WHEREAS, the Chatham Community Fire Protection District has determined that the reimbursement for technical rescue services performed by the Chatham Community Fire Protection District is an effective and efficient method of ensuring the safety of those individuals requiring technical rescue services; NOW, THEREFORE, BE IT ORDAINED by the Chatham Community Fire Protection District, through its Trustees, as follows: 1. For the purposes of this ordinance, “technical rescue services” shall include, but is not limited to, structural collapse, trench collapse, below grade rescue, tactical rescue, high angle rescue, high elevation rescue above four stories, water rescue or recovery, underwater rescue or recovery, confined space rescue, whether performed by members of the Chatham Community Fire Protection District or requiring the assistance of non-Chatham Community Fire Protection District personnel or equipment. 2. A fee is hereby imposed to reimburse the Chatham Community Fire Protection District for technical rescue services provided or directed by the Chatham Community Fire Department in an amount sufficient to reimburse the Chatham Community Fire Protection District for the reasonable cost of providing those technical rescue services, which costs shall include: (a) personnel costs at the scene as well as any callback costs. Said costs shall not exceed the personnel costs set forth in this ordinance; and (b) vehicular and equipment costs used at the scene at a rate not to exceed the vehicular and equipment costs set forth in this ordinance; and (c) disposable equipment costs used at the scene.
3. The fees for technical rescue services provided by Chatham Community Fire Protection District, through its agents or employees, or such services as provided by any other fire protection district responding to an emergency pursuant to a Mutual Aid Agreement with the Chatham Community Fire Protection District shall be in an amount equal to the following: (a) $125.00 per hour per vehicle or apparatus; (b) $35.00 per hour per firefighter, line officer or engineer; (c) $35.00 per hour per paramedic.
To the extent that technical rescues services involve the use of MABAS Division 48 Specialized Technical Response Team, the charges shall be as follows: (a) $100.00 per hour per response trailer; (b) $75.00 per hour per decontamination trailer; (c) $65.00 per hour per foam trailer; (d) $60.00 per hour per team trailer; (e) $35.00 per hour per personnel, including any officer or team member.
Charges for any technical rescue services shall also include the actual replacement cost for any expendable item that was employed or used in the rescue operation. 4. The fees imposed by this ordinance shall be the responsibility of all of the following parties whose actions or omissions were a cause of the need for technical rescue services: (a) the owner of the property on which the technical rescue occurred; (b) any person involved in an activity that caused or contributed to the need for the technical rescue services; (c) a person or persons who are rescued during the emergency and his or her employer if the person was acting in furtherance of the employer’s interests; (d) in cases involving the recovery of property, any person having control or custody of the property at the time of the emergency.
5. The Fire Chief shall make the determination of the party or parties responsible for the fees imposed hereunder and shall bill such parties accordingly. Chatham Community Fire Protection District may seek or pursue payment of any unpaid fees against any person or entity responsible for such fees under this Ordinance. 6. This Ordinance shall take effect and be in full force and effect ten (10) days after its passage and publication by the Board of Trustees of the Chatham Community Fire Protection District and may be published in pamphlet form.
